Me and Colin (Draconis) were out tooling around after eating a delicious breakfast/dinner at Beth's Cafe in Greenlake.  And he decides he wants to video my car, so our buddy David (Mr.510) is riding shotgun with Colin and Colin hands him his phone and is having him record.  Long story short, I'm coming down a small hill on a bypass they have with construction, and I see a pickup in the left lane, I'm in the right.  Don't think anything of it.  He's going kind of slow, probably about 5mph under the speed limit.  Just as I'm getting "right behind him" he signals/saws the wheel to make it to the exit lane.  this is a two lane, temporarily three with the exit, highway.  I barely catch a glimpse of his signal before he's right in front of me.  Panic swept over me and I steered right and slammed on the brakes.  Made all four lock up, car starts to go sideways, his bumper makes sweet sweet love to my hood and grill.  Now, in most states, the person doing the rear ending is at fault, almost ALWAYS.  Doesn't matter what.  But... remember earlier when I said David was filming? BWUAHAHA.

So this guy that was driving was super calm, all for swapping insurance information.  But then his two little buddies got out of the truck and started talking shit, saying it was my fault cause all the damage was on the car, and nothing on the truck.  And that's when I said "I have all this on video" and they started calling me a liar and just saying all sorts of mean and nasty things.  This is when I called 911.  Some city cops came, took our information down and gave it to the other party.  Apparently the guy that was driving didn't say ANYTHING.  I'm just going to assume he's been in this situation before, knew it was his fault, and didn't want to say anything incriminating.  But his buddies were telling the cop that me and colin were drag racing, and that I was drunk, just all sorts of crap. 

Got a claim filed this morning, a claims adjuster is coming out tomorrow morning.  I'm not going to let them total the car.  the cleanliness, the low miles, and the rarity.  I'm going to fight it tooth and nail and never settle if they say they're going to total it.

And without further adue, here is the video.  I chopped it down to the last 15 seconds of the video, as that's all that matters.  You will have to watch it a few times, as it all happens so fast.

That sucks big balls.
In my state, crossing the solid white line is a big deal. That would have squashed any debate to fault from the squad. They would've looked at that owner and said "You recklessly and very illegally switched lanes."
Regardless of my speed.

Shitty shitty, shitty. Glad no-one was hurt.

More importantly though, looking at your picture, you can see that their bumper made it from the left side of your car, to the right. Completely missing your drivers side headlight.
And in the video, between 3-5 seconds, you can clearly see the truck straddling the white line, on it's way into your lane.

Everything other than that though is kind of hard to make out. Shaky video (Which is a cell phone, bound to happen)

I love the fact that they tried to implicate that we were drunk. First off, we dont drink. I know for a fact that I dont drink and neither does David. And even if Dennis does, he sure didnt that night. There was no reason to even come to the conclusion that we may have even drank in any form. Everyone knows, and even those who are not local and live in SoCal, Australia, and the Netherlands that I do not drink. That is really funny.

The other thing. The fact that we were drag racing. Wouldn't that require us being in two lanes? And the fact that I was so far behind him at a safe distance, how would that implicate we were even racing anyway? Just because they saw two imports that are of a sporty nature and the fact that my car is obvious for what it is, try to put the blame on us.

Here too Jay, you are not to cross a solid white line separating two lanes.

Assholes drive like the guy in the truck all the time, here. I can't think of a time I've been on the highway, someone hasn't cut all the way across like that.

The drag racing claim is the best. Wouldn't Colin be in front? That sucks about your car dude. Hope the damage isn't too bad and you can get it back up to snuff.

And I think my car looks just as sporty as yours colin, mine just doesn't have as flashy of wheels!  But it does have that killer domestic "rake" to it. 

As for the damage, all that I can tell is what I can see, I have not popped the hood, just in case.

The hood for sure, the grill is in a whole bunch of pieces, the metal strip that goes below the grill.  The very top of the bumper is marred, it may just need to be repainted.  And the headlights are "cross eyed" and that's probably because the core support is slightly bent from the hood latch being pushed back.

Those metal crossbars under the lights are easy for me to find and I have tons of grills. Just be happy it wasn't much much worse.

Basically going to need from about two to three inches behind the headlights, forward.  both the radiator and a/c condenser are bowed, looks like the way the hood crumpled kept the hood mounts from getting damaged, and miraculously, the fender's appear to be fine.

Got the repair estimate today.  Just short of $4300.

$1762.57 in parts.
$1080 in Body Labor
$1065 in Paint Labor/Supplies

and then tax at 9.5%

Things aren't looking well, but I will demand an unbranded title.  This is a classic limited production vehicle after all.

this is a lesson for everyone if you are going to put money into a older car you should get a rider on your insurance to cover something like this most times they dont want it as a daily driver or they put a mileage limit on it for how many you can drive a year and it really isnt that expensive. i dont know your state laws but in a some of states now they have to issue a salvage title and they cant sell it back to the owner it has to go to the auction and this is the policy of some insurance companies now. i wish you all the luck

Damn. Also when owning an older car you should learn how to do all this stuff yourself or align yourself closely with people who can do it themselves because that's WAY too much to be spending for that. Just buy another S12 at this point and part that sucker out.

Sorry, I guess I should have specified.  This estimate is from the insurance appraiser. He just did a visual inspection of the parts that needed to be replaced in my driveway.

In the real world, parts and labor will be half of the estimated cost, and paint will more than likely only run me a third.

Andrew, I know you're a well known guy around here and all, but all of your posts, in my threads, rub my fur the wrong way, if you get what I'm saying.  It's like you KNOW me and THINK you know what I'm going to do with MY car.  I'm NOT going to let my car get impounded or hauled away for scrap.  So... I can deliver just as well as receive.

I don't know how I "know you" or "think I know what you're going to do"... that part I had to read like 4 times to try to get some kind of semblance of what you're talking about. I didn't pay too much for my car.  I paid exactly what I wanted to pay for my car.  I got an, essentially, unabused brand new car.  Sure, it had 113,000 miles on it when I got it, but it made my moms '01 and my dads '05 look like shit.  Put it up against most other used cars of the same era, and they couldn't have held a candle to it.

Got an email today, the claims adjuster was able to get ahold of her client, the guy that hit me.  She replied with "We will be taking care of your claim."

Still don't know how much I'm getting or if they are going to consider the car totaled.  If they do, I'm going to argue the point of, it's a classic (she just turned 25 last month), ultra low miles (considering the year! my girlfriends 06 jetta has 147k), and limited production run.

Sounds like you have a good plan. They are going to try to total it. You can buy it back if you can't convince them to repair it (this will give the car a rebuilt title :(. Do your research for other low mileage S12's. I see low mileage S12's in excellent condition for 2-3k. Use those and the how rare it is to find a car in that condition as your leverage.

How are you feeling? If they try to screw you on your car go to the doctor and rack up some medical bills. Let me know if you have any questions on the claim. I do that crap for a living.

If they do attempt to total it, I will tell them I will buy it back if they don't brand the title as that will lower the value of the vehicle, and nothing majorly structural is damaged on it.  My lower back is giving me more grief than it usually does, but only when I wake up, I was asked several times if I was injured the accident and I have said no, would that be able to come back on me if I go "oh crap... my back!"??

You should always go to doctor first before admitting whether hurt or not. Either way I am sure you could still seek medical attention.

They're gonna total it no matter what. Damages are more than price of vehicle. My SE was totaled when I bumped a fender and bent a rack. Think how gay I felt.

Yeah they're gonna total it. I smashed a $50 CV axle on the Saturn, and blew the passenger side tires, once, and a friend who works for our insurance company told us, good thing we didn't report it, because they'd have totaled it, then probably replaced the stuff and sold it for way more than it was worth.

Fuck insurance companies, and always say you got your ass injured.

Some news.  They are still totalling the car as far as I know, but I was able to strong arm them in to giving me just over $3,900 after buying it back from them at salvage costs.

Not a bad deal for only buying the car 9.5 months ago for $3,000.  Just word to the rest of you, NEVER take the first offer from an insurance company.  I was told by several people that I should have just taken their first offer of $2600.  And once the car is fixed, I should be able to get the salvage title taken care of after a short trip to the Washington State Patrol inspection station.

I feel your pain silverton. some dumb broad totaled my pristine s13 parked in front of my house and the insurance wanted to give me 1200. After about a month and a half of fighting I got 4000.

The "Total Loss Adjuster" explained to me about this company, CCC One (they research market value of vehicles), that found three of my car within 150 miles from where i live.  I got the report today, and the cars compared to mine were two XE's and one SE, and they were 1,053, 2,385, and 2,487 miles away, respectively.

From the looks of it they just found the cheapest cars available in the US.  And I called them out on it and said the SE can NOT be compared to the XE, so I sent her my findings of SE's around the U.S using crazedlist.

they tried to do that to me. they found info on the base model 240sx and tried to quote me like that.

mine was a showroom clean sunroofless 89 SE coupe with 120k miles on it. they were sending me listings for hatches with 180k plus on 'em.
